Governance in Procurement
Governance in procurement refers to the external and internal legislation, frameworks, guides etc that govern a procurement process.
External factors include but are not limited to:
- Legislation (such as the Public Governance, Performance and Accountability Act 2013 (Cwth)
- Case law (such as Waltons Stores (Intestate) Ltd v Maher 1988 164 CLR 387)
- Rules (such as the Commonwealth Procurement Rules)
- Policy (such as the Policy for the responsible use of AI in Government)
- Frameworks (such as the Protective Security Policy Framework, Risk Management and the National Framework for the and guidance of Artificial Intelligence in Government); an
- Manuals (such as the Information Security Manual).
Procedural internal agency arrangements and systems that may govern a federal government procurement process may include but not be limited to:
- Accountable Authority Instructions
- WhoG arrangements
- Strategic procurement
- Risk Management Frameworks
The Commonwealth Procurement Guidelines (CPG) also address governance to include the conduct and accountability of personnel undertaking federal government procurement activities. Failure to adhere to this may lead to various negative actions such as demotion or termination of employment. In addition, governmental inquiries (both internal and external) into agency procurement practices occur regularly.
